We cannot accept responsibility for damage or loss of original photographs. We advise that all hard copy photographs are sent to Bespoke Photo Design LTD by registered post. Bespoke Photo Design LTD will return your original photographs by registered post and your product by our courier (UK only is free of charge). We regret we are unable to give refunds. In the unlikely event of a manufacturing fault, it will be repaired or replaced. You accept that a photograph when enlarged may lose some definition and that colour variation may occur in the finished item (perhaps brightening). For picture cropping and editing your original photo will be digitally copied. You accept we need to exercise a degree of license to crop and eit images to fit and to achieve the best results. If you have a specific edit request, please state in the above box 'Retouching & Effects'; The removal of red eye or date stamp, blemish reduction, black and white conversion is a free of charge service and is at our discretion. We are not obliged to make these adjustments and do so without liability in order to help achieve the best results.

Orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. We have as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. You should also be aware that colours may vary when printed, especially when printed onto different media.

To the extent permitted by applicable law, Bespoke Photo Design LTD disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Bespoke Photo Design LTD shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Bespoke Photo Design LTD makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Bespoke Photo Design LTD shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Customer Works and Bespoke Products

Should you choose to send to us any photographs, artworks or any other items ("Customer Works"), you must do so at your own cost and risk.

Whilst Bespoke Photo Design LTD will use all reasonable endeavours to safeguard all Customer Works and return them to you, Bespoke Photo Design LTD cannot be held liable for any loss or damage to Customer Works. Accordingly, you should ensure that you have retained a personal copy of any irreplaceable item which you may choose to send to us. We recommend you send all hard copy photographs to Bespoke Photo Design LTD registered post and we will return all hard copy photographs back to you registered post.

Please note that photographs cannot be smaller than a passport sized photo or larger than A4 size. The print quality will depend on the quality of the original item.

By sending to us any Customer Works, you warrant that:

(i) you have full and exclusive right, title and ownership to the Customer Works;
(ii) the Customer Works do not infringe any third party rights;
(iii) the copying, modifying or creation of any derivative work from the Customer Work which you may have requested will not infringe any third party rights.

In the event of breach by you of these terms, you agree to indemnify Bespoke Photo Design LTD from all costs, claims, liability and damages that it may incur as a result

Unfortunately, we are not able to refund or replace any Bespoke Products. You will, however, be entitled to a replacement of th

Bespoke Product if the product is flawed as a result of our negligence or error.

Delivery Times and Charges

Delivery times are as follows

· Photomontage Products will be delivered within 21 days after sign off from your proof - please allow 7 days for your proof

· Single Image Products will be delivered within 21 days on receipt of your image

· Photobooks will be delivered within 21 days after sign off from your proof - Please allow 21 days for your proof

· UK delivery is free of charge on all our Bespoke Products

· Any hard copy photographs will be returned registered post free of charge, and will arrive separate to your Bespoke Product

· We mainly use our courier UPS for all deliveries. However in some instances we may use Royal Mail standard service.

Acknowledgment and Acceptance of your Order

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order. However, please note that our acceptance of your order will only take place upon despatch of the product(s) ordered.

Whilst Bespoke Photo Design LTD makes every effort to ensure all our customers are satisfied with their purchases, 55 Max does exclude all liability to the extent permissible by law, for all warranties relating to the quality, description and purpose of use of the goods. Bespoke Photo Design LTD cannot be liable for any direct or indirect losses, including loss of profit or business.

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Bespoke Photo Design LTD. If any provisions of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

The maximum liability of Bespoke Photo Design LTD shall not exceed (at the discretion of Bespoke Photo Design LTD) either the cost of the goods or their replacement value.

Bespoke Photo Design LTD will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we will not be liable for any unauthorised access to information supplied by you.
